Liability Waiver & Release

Who and what this agreement covers

This Liability Waiver and Release Agreement (the “Agreement”) is between you (the “Participant”) and Cappy with Ali, located at 8250 W 3rd St, Suite 206, Los Angeles, CA 90048, including its owner, instructors, teachers, assistants, staff, and independent contractors (collectively, the “Studio”). It applies to every class, workshop, event, private session, and use of the Studio’s space that you book or attend, including classes attended with a 10-session package, a make-up credit, or any other pass.

This Agreement is versioned. The version in effect when you book is the version that applies to that booking. If the Studio updates this Agreement, the new version will appear on this page with a new effective date, and you will be asked to accept the current version at your next booking.

Health, physical condition, and voluntary participation

You confirm that you are in good physical health and know of no medical or other condition that would make it unsafe for you to take part in a movement, dance, or meditation class. If you have any doubt — including pregnancy, recent surgery, injury, heart or respiratory conditions, or any medication that affects balance or exertion — you agree to consult a physician before attending.

Your participation is voluntary. You choose the classes you attend and the pace at which you move, and you may pause or stop at any time. You agree to listen to your body and tell the instructor about anything that limits your movement.

Assumption of risk

Physical activity involves inherent risks that cannot be eliminated, even with careful instruction and a well-kept space. These risks include, but are not limited to: muscle strains, sprains, and cramps; cuts, bruises, and twisted joints; falls; collisions with other participants, the floor, walls, props, or equipment; dehydration, overheating, dizziness, or fainting; aggravation of pre-existing conditions; and in rare cases more serious injury.

You understand and voluntarily accept all such risks, whether known or unknown, foreseen or unforeseen, and you assume full responsibility for your own participation, choices, and well-being during classes.

Release of liability

To the fullest extent permitted by California law, you hereby release, waive, discharge, and covenant not to sue the Studio from any and all claims, demands, or causes of action arising out of or related to your participation in classes or your presence at the Studio, including claims for bodily injury, illness, death, or damage to or loss of personal property, where such claims arise from the ordinary negligence of the Studio.

This release does not apply, and nothing in this Agreement releases, waives, or limits, any liability that cannot lawfully be released or limited under California law — including liability for gross negligence, recklessness, or willful, wanton, or intentional misconduct, or any other conduct described in California Civil Code § 1668 or other mandatory law.

Medical treatment and emergency care

You authorize the Studio and its instructors to secure emergency medical care or transportation for you if you appear to need it, and you accept financial responsibility for the cost of any such care. You agree to keep your booking contact details current so the Studio can reach your emergency contact if needed.

Personal property

You are responsible for your own belongings. The Studio is not a bailee of your personal property and is not responsible for items that are lost, stolen, or damaged at the Studio, except where that loss results from the Studio’s gross negligence or willful misconduct.

Indemnification

You agree to indemnify and hold harmless the Studio from any claim brought by you, or on your behalf, that is inconsistent with this Agreement, and from damage you cause to the Studio’s space, equipment, or other participants through your own negligence or misuse of the facilities.

Minors (participants under 18)

Participants under 18 years old may only attend with the consent of a parent or legal guardian. The parent or guardian must accept this Agreement on the minor’s behalf (including by completing the booking for the minor) and agrees to all of its terms for themselves and for the minor. If you are completing a booking that includes a minor, you confirm that you are that minor’s parent or legal guardian and that you accept this Agreement on the minor’s behalf.

Communicable illness

You agree not to attend a class while you have a fever, or any contagious illness or symptom that could pass to others. If you attend while ill, you accept the risk to yourself and to others around you.

Studio rules and instructor decisions

You agree to follow the Studio’s posted rules and the reasonable instructions of the instructor and staff, including any instruction to modify or stop an exercise for your safety. The Studio may decline entry to, or ask to leave, anyone who refuses to follow rules, appears unable to participate safely, or is under the influence of alcohol or drugs.

General terms

Governing law. This Agreement is governed by the laws of the State of California, without regard to its conflict-of-laws rules.

Severability. If any part of this Agreement is found unenforceable, that part is modified to the minimum extent needed to be enforceable, and the rest of the Agreement stays in full force.

Entire agreement. This Agreement is the entire understanding between you and the Studio about the risks of participation and the release of liability, and it replaces any earlier verbal or written statements on those subjects.

Electronic acceptance. You agree that checking the agreement box during booking, or otherwise accepting this Agreement electronically, is a valid electronic signature under California law (Cal. Civ. Code § 1633.1 et seq., the Uniform Electronic Transactions Act), and that a copy of this page, together with the booking record, is a record of your acceptance.
